Terms and Conditions for Water Ionization Purchases via Term Funding
By being approved for funding you are accepting these Terms & Conditions. Please read these Terms & Conditions before placing an order.
In these Terms & Conditions
“We”, “us”, “our” and “ourselves” is a reference to BFS, Inc.
“You” means the person approved for financing placing an order.
“Unit(s)” or “products” means an alkaline water ionization machine.
“The purchase is agreed” – by completing and submitting an on line order form, you are making an offer to purchase products which, when accepted by us, will result in a binding agreement. An acceptance email from us confirms that the agreement has commenced.
By using the website to buy units online, you confirm that you are at least 18 years old.
Ordering
1.1 By completing and submitting an order form with BFS, Inc., you are making an offer to purchase water ionization units which, if accepted by us, when accepted by us, will result in a binding agreement. Please note that units will not be sent (or links to online products) until we have received full payment to include cost of units (s) thru BFS, taxes and shipping charges. We will not be liable if there is a delay from manufacturer, and we will not have units shipped unless all costs are covered.
Certain steps must be followed for the order to be placed, as described below.
1. A BFS invoice must be signed and dated agreeing to the unit(s), tax, shipping and credit card processing fees (if any).
2. All product order forms must be signed and dated.
3. Form of payment needs to be included at time of ordering in the form of credit card, check or money order. (Checks and money orders can now be sent via small phone device. Call for details)
After you have placed your order:
1. You will receive an email to acknowledge your order has been placed.
2. Unit(s) will be delivered via ground transportation or can be picked up at the manufacturer warehouse.
Orders will not be completed and may not ship if for example:
• Warehouse is out of stock
• A balance remains, your payment has not cleared or been declined
• There is a discrepancy within the order the price or other details of the products
• You have cancelled or changed the product order, however, the loan will remain active
2. Cancelling an order before the product has been sent
2.1 If you change your mind after placing an order, you can cancel it at any time before unit(s) are shipped, however, a $100 processing charge will be assessed upon return of all monies. Please refer to the Return Policies of the respective manufacturer you are ordering from.
3. Returning products after sending
3.1 Each unit sold through BFS, Inc. holds no involvement with regard to return items once unit has been shipped. If you are not satisfied with the product after receiving it, contact your sponsor or the manufacturer for any and all product return issues.
4. Pricing and payment
4.1 Prices through BFS, Inc. are quoted in U.S. dollars, and payment can only be accepted in U. S. Dollars. Taxes, delivery costs and credit card fees (if any) will be added to the total price of your purchase.
4.2 While we make every effort to ensure that the products shown on our website are currently available at the price shown, we cannot guarantee that this will always be the case. If products you have ordered are unavailable, you will be notified as soon as possible.
4.3 The price you pay is the price of the unit(s) at the time you place your order, even if the price of the unit(s) has since changed or varies elsewhere, including the manufacturer, BFS is not obligated to match any discount pricing while offering the convenience of ordering unit(s) with no money down.
4.4 Your payment card will be debited for your order at the time the order is placed. By submitting an online order with BFS, Inc., you expressly agree not to request a ‘charge back’ of any fees or payments for said orders, and that no dispute with BFS, Inc., will be raised with or adjudicated by the credit card company. Rather, you agree to contact BFS, Inc. directly to resolve the issue or obtain a refund pursuant to the product guarantee.
4.5 Where an offer mentions that an item is reduced in price, e.g., cash-price, the discount will be calculated at full BFS pricing and not through any means of manufacturer or alternative payment methods
5. Delivery information
5.1 Please see individual manufacturer product sales pages for information about delivery and shipping charges, where applicable.
5.2 For products that require shipping, we will email you as soon as your order has been shipped, and will advise of the shipping method at that time.
6. Liability
6.1 Whilst we endeavor to ensure that the content of this site is genuine and accurate we shall not be liable for any inaccuracies or misrepresentations whether made by us or a third party.
6.2 We shall not be liable in any way for any consequential loss as a result of the website being unavailable or malfunctioning.
6.3 We will endeavor to assist you in maximizing the performance of your teams through the unlimited use of this website and our lender portal, however, we will not be liable in anyway if it fails to perform as expected.
6.4 We shall not be liable for the performance or lack thereof for any advertising through BFS, Inc.
6.5 We shall not be liable in any way in the highly unlikely event that the unit(s) become damaged, lost or stolen.
6.6 You acknowledge and agree that any agreements made between you and your sponsor, re-sellers, merchants and manufacturers, excludes BFS and its Lending Partners from these terms and conditions and neither BFS nor its Lending partners shall be liable for any loss of any kind resulting from such agreements.
6.7 We shall not be liable for any consequential loss resulting from a third party product or service sold directly or indirectly through our website.
6.8 We shall not be liable for any failure to deliver on time any goods or services supplied by sponsors, resellers, merchants and manufacturers.
7. Changes to Terms & Conditions for buying products online
7.1 We reserve the right to change these Terms & Conditions for buying any and all products online from time to time. If this happens, we will notify you by posting the new Terms & Conditions for buying products online on the website. If you do not wish to be governed by the revised Terms & Conditions for buying products online, you must not place any further orders.
7.2 These Terms & Conditions for buying alkaline water ionization units through BFS, Inc., and its agents via this website, are governed by the law of the United States and the State of Nevada and you and we agree to use the Nevada courts should any dispute arise.
7.3 If any part of these Terms & Conditions for buying unit(s) online is found to be invalid by law, the remainder of them remain valid and enforceable.
